YOUR USE OF FSA
Our Agreement with You
The Formwork and Scaffolding Association of the Philippines (FSA) provides this website and its services subject to the following Terms and Conditions. By accessing fsa.ph or participating in FSA activities, you agree to be bound by these terms. Please read them carefully before using our website or applying for membership.

Acceptance of Terms
By accessing or using the FSA website (fsa.ph), registering as a member, or attending any FSA event, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please discontinue use of our website and services immediately.
These terms apply to:
- Website Visitors — Anyone who accesses fsa.ph, regardless of membership status.
- FSA Members — Individuals or companies that have registered and been accepted into the association.
- Event Attendees — Persons who register for or attend FSA-organized events, seminars, or meetings.
- Applicants — Individuals or entities submitting a membership application via the website or other channels.

Membership Eligibility & Obligations
FSA membership is open to companies and individuals operating within the formwork and scaffolding industry in the Philippines. By applying for or maintaining FSA membership, you agree to:
- Provide accurate, complete, and up-to-date information during application and throughout your membership.
- Abide by FSA’s Code of Conduct, bylaws, and any guidelines issued by the Board of Directors.
- Pay membership dues and fees on time, as determined by the FSA Board.
- Represent FSA in a professional manner at all times — in dealings with clients, government bodies, and other industry stakeholders.
- Not engage in any activity that brings disrepute to the association or its members.
FSA reserves the right to approve, reject, suspend, or terminate any membership at its sole discretion, particularly in cases of misconduct, non-payment of dues, or violation of these Terms.

Use of the Website
You agree to use fsa.ph only for lawful purposes and in a manner consistent with these Terms. The following activities are strictly prohibited:
- Unauthorized access to, or interference with, any part of the website or its underlying systems.
- Uploading or transmitting any malicious code, virus, or harmful content.
- Impersonating FSA, its officers, staff, or any other member.
- Scraping, copying, or reproducing website content for commercial use without written permission from FSA.
- Using the website to distribute spam, unsolicited communications, or misleading information.
FSA reserves the right to restrict or terminate access to any user who violates these conditions, without prior notice.

Intellectual Property
All content published on fsa.ph — including but not limited to the FSA logo, text, images, event materials, publications, and website design — is the exclusive property of the Formwork and Scaffolding Association of the Philippines or its licensors.
- You may not reproduce, distribute, or use any FSA content for commercial purposes without prior written consent from FSA.
- Members may use FSA branding materials (e.g., “Proud FSA Member” badge) solely for the purpose of identifying their membership, in accordance with brand guidelines issued by FSA.
- Any unauthorized use of FSA intellectual property may result in legal action under applicable Philippine laws.

Events & Activities
By registering for any FSA event, seminar, or general assembly, you agree to the following:
- Attendance confirmations are binding; please notify FSA Admin at least 48 hours in advance if you are unable to attend.
- FSA may take photos and videos during events for use in official publications, social media, and promotional materials. Attendance constitutes your consent to being photographed or filmed in such settings.
- FSA is not liable for any personal injury, loss, or damage incurred during events held at third-party venues.
- Event fees, where applicable, are non-refundable unless the event is cancelled by FSA.

Limitation of Liability
To the fullest extent permitted by Philippine law, FSA shall not be held liable for:
- Direct or Indirect Damages — Any loss of business, revenue, data, or goodwill arising from the use of or inability to use fsa.ph or FSA services.
- Third-Party Actions — Any disputes, damages, or claims arising between FSA members or between a member and a third party.
- Website Downtime — Interruptions, errors, or unavailability of the website due to technical issues, maintenance, or circumstances beyond FSA’s control.
- Inaccuracies — While FSA strives to maintain accurate and current information on its website, we do not warrant that all content is free from errors or omissions.
FSA’s total liability, in any case, shall not exceed the amount of membership dues paid by the affected party in the preceding twelve (12) months.

Dispute Resolution
FSA encourages amicable resolution of disputes between members. In cases where a formal process is required:
- Disputes between members shall first be submitted to the FSA Board of Directors for mediation.
- If mediation fails, disputes shall be resolved through arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- The venue for any legal proceedings shall be the proper courts of Las Piñas City or Metro Manila, at FSA’s option.

Disclaimer of Warranties
FSA provides its website and services on an “as is” and “as available” basis, without warranties of any kind — either express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
FSA does not warrant that:
- The website will be uninterrupted, error-free, or free from viruses or other harmful components.
- Any information provided on the website constitutes legal, financial, or professional advice.
- Results obtained from the use of the website or FSA services will meet your specific requirements.

Changes to These Terms
FSA reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Members will be notified of significant changes via the FSA Viber group or email. Continued use of the website or FSA membership services after any changes have been posted constitutes your acceptance of the revised Terms and Conditions.
